Terms and conditions

Version 1, September 2026. These terms cover everything I do for you unless we agree something different in writing. They go with my proposal and the offer and acceptance sheet. I have kept them short and in plain language. If anything is unclear, ask before you sign.

1. Who is who

Obie Digital is Stephen O'Brien, trading as Obie Digital. "I" and "me" mean Obie Digital. "You" means the business named on the offer and acceptance sheet.

2. What I will do

I do the work listed on the signed offer and acceptance sheet, and nothing else. Anything outside it is extra work (see section 7).

3. Prices and payment

  • Your prices are on your offer sheet. They are in New Zealand dollars, and I am not registered for GST, so none is added.
  • A proposal is valid for 30 days from its date.
  • Website build: a 50% deposit when you accept, and the balance when the site goes live.
  • Monthly services are invoiced monthly. Every invoice is due 30 days after the invoice date.
  • Google ad spend is paid by you straight to Google. It is separate from what you pay me.

4. What I need from you

  • Access to your Google Analytics 4 property, or permission for me to create one for you. This is a condition of every job. Without it I cannot report on anything.
  • Access to the other accounts the work needs, such as Tag Manager, Search Console, your Business Profile, Google Ads, and your domain and DNS. Please invite me at stephen@obiedigital.co.nz rather than sending passwords.
  • Your content, photos and approvals on time. If they are late, the work is late.
  • Checking the claims made on your site and in your ads. I write in plain language, but you are responsible for what your business says. If your profession has advertising rules (lawyers and dentists do), check them and approve the wording in writing.
  • Your website's own privacy policy.

5. Who owns what

You own your domain, your Google accounts and your website code once it is paid for in full. Until then the code stays with me. I will ask you before I show your name, logo or site as an example of my work.

6. Website care plan and hosting

  • The care plan runs month to month. Either of us can stop it with one month's notice by email.
  • It includes hosting (the security certificate renews automatically), my checks that your site and forms are working, one hour a month of changes, fixes and questions, and live dashboard access.
  • The care plan is compulsory when I host your site.
  • If your own IT person looks after your domain and DNS, I still host the site. I will give them the short list of records the site needs. They keep those in place and tell me before changing them. I am not responsible for downtime caused by a DNS change or a lapsed domain.
  • I check the site and forms during business hours. I do not offer out-of-hours monitoring.

7. Support, changes and extra work

  • Send every request to one email address: stephen@obiedigital.co.nz. I reply within two business days. There is no out-of-hours cover.
  • I log my time in 15 minute blocks. Your included hour does not roll over to the next month.
  • Changes beyond the included hour, landing page work, and anything not on your offer sheet are charged by the hour. I tell you before I start.
  • If something I built does not work as agreed, I fix it free for 30 days after go-live.

8. SEO and Google Ads

  • The SEO retainer runs for a 3 or 6 month term, as set out on your offer sheet, then month to month. Results take time, so I recommend 3 to 6 months.
  • Nobody can honestly promise a ranking or a number of leads, and I do not. Results depend on Google, your competitors and your site. What I promise is the work on your offer sheet, done properly, and a report on what happened.
  • Google Ads is Google only, Search campaigns only. Management runs month to month with one month's notice, and needs a minimum ad spend of $1,500 a month.

9. Leaving and handover

If you leave the care plan, or bought a build only with no hosting, handing over your website files is charged as one hour of work. Work you have paid for stays yours.

10. Things outside my control

I rely on Google, my hosting provider and other platforms. Their outages, changes and policy decisions are outside my control. I will tell you if something affects your site.

11. Your information

How I handle personal information, yours and your customers', is in my privacy and cookie policy and the privacy notice that comes with your proposal.

12. Changes to these terms

The version you signed applies to the work you signed for. If I update the terms, the new version applies to new work only.
